General Terms and Conditions of Sale

The present general Terms and Conditions of sale apply between: Design and Asia limited company, Kowloon Hong Kong, contact@designandasia.com, editor of the www.designandasia.com website (Publication Directors: Mr Sacha Souffran Mme Amandne Dapsens), hereafter called "Design and Asia" and any physical person residing in the zone covered by the offer and making a purchase on the www.designandasia.com website, hereafter called "the customer".

This Agreement aims to define the modalities of the mail order sale between Design and Asia and the customer, from the order through payment and delivery.
This Agreement covers all the necessary steps for placing the order and insures the tracking of the order between the contracting parties.
The customer's acceptance of the present Agreement does not necessitate any handwritten signature, but is confirmed simply by validating his order.
The sales contract for an article purchased on the site is comprised of the terms of the Agreement in force at the time the order is placed and the order is confirmed.
The Agreement applies for the whole duration of the period that www.designandasia.com is online.
The Agreement can be modified, and the Agreement that applies is the one in force on www.designandasia.com website on the date the customer places his order.


1- Product

The products offered for sale byDesign and Asia are those on the www.designandasia.com website on the day the site is consulted, and this in the limit of stocks available from the supplier.
In the event that a product is definitively and permanently unavailable after an order has been placed, the customer will be informed by mail. We will ty to find a similar product. In case we don't, the product will be reimbursed. .

Product descriptions
The products offered on the website are presented and described with almost attention to exactitude, with the help of texts and pictures created for the most part by Design and Asia based on suppliers' documentation. However, Design and Asia assumes no responsibility for any errors or omissions in the presentation.


2- Ordering

In order to allow the internaut to modify his order before definitively validating it, www.designandasia.com website proposes successive confirmation screens up to the final validation.
The order is considered accepted by the customer in all its aspects (price, product description of ordered goods, delivery address, delivery time, shipping charges) when he clicks the online payment validation box.
Clicking the validation box equally implies the express and irrevocable acceptance of the Agreement.

Consequently, Design and Asia cannot be held accountable for any typing errors committed by the customer concerning his delivery address nor any resulting consequences (for example delays or delivery errors).
The cost of lost product or re-shipping the order will be charged to the customer.
When an order is recorded, an e-mail is sent to the customer, confirming that his order has been taken into account, thus concluding the contract.
Design and Asia has the right to refuse an order for any serious reason, notably one linked to a problem of supply.

In case Design and Asia cannot deliver the order because the product is out of stock, Design and Asia undertakes to inform the customer at the earliest possible time and to propose a new delivery schedule. The customer will then have the choice of either accepting the new delivery schedule or being reimbursed. He will confirm his choice by email. If there is no confirmation, it will be considered the customer has accepted the new timeframe for availability proposed by Design and Asia.

3-Price

The price guaranteed to the customer is the one posted on the site at the time of purchase. It is quoted in US$. It include shipping costs for every ordering equal or upper to 60 euros (convert in US$ according to actual exchange rate). For every order lower than 60 euros (convert in US$ according to actual exchange rate) shipping cost will be billed separately and indicated on the order confirmation form.

4- Payment

By validating his order, the customer promises to pay the total amount of the order including the cost of the products ordered and delivery costs (if not included).
Payment must be done online by credit card only.
Secure payment
Credit card payments for purchases on Design and Asia website are managed by XXX a pioneer and leader in online payments, puts into effect all necessary means to guarantee that the payment transaction is secure.

5- Ownership

Design and Asia maintains full ownership of the sold merchandise until full payment is received. From the time the sold merchandise is accepted by the customer, the burden of risk, damages or loss is transferred to the customer, who should therefore be careful to conserve the goods in a proper manner.


6-Delivery

Shipment
On the date the package is shipped to the customer, Design and Asia will e-mail the customer a notification of shipment.

The merchandise is delivered to the address indicated by the customer on the order confirmation form. Every mistake made by the customer himself about his shipping adress will engage his own responsability.

Shipping costs
Shipping costs depend on the size and weight of the package and the location of the delivery zone. Shipping costs or included in every ordering equal or upper to 60 euros (convert in US$ according to actual exchange rate). Custom expenses are not included and could be eventualiy claimed on receipt of the package. Please ask to your administration for further information.

Delays in delivery
Delivery time is indicated approximately. A delay in delivery cannot give rise to any reimbursement for damages plus interest nor to a cancellation of the order .

In case the package is not delivered after the delay mentionned on your order, the customer is asked to notify Design and Asia by e-mail.
A claim will be filed with the Post office. If the parcel is found, it will be re-expedited in the shortest time possible to the customer’s address.
If the parcel is not found,Design and Asia will provide a proof to the customer showing the package has left the country of origin. Will be borne by the customer to undertake the necessary steps in the recipient country.
If the package is considered lost Design and Asia will not be held responsible.

Customer absence
In the case of delivery by La Poste, in the event that a customer is absent for a delivery, the mailman will leave a notification. The parcel will be kept at the post office for 15 consecutive days. The customer can collect the parcel from the post office which is indicated on the notification form by showing proper identification. In the event that the customer does not pick up the parcel within 15 days, the merchandise is returned to Design and Asia , who reservess the right to cancel the order and to refund the customer the amount paid, less real shipping costs for delivery and return and any other related costs.

7-Claims and returns

Irregularities during reception of goods
In the event of the slightest delivery problem, it is essential that the customer conserve all the elements in the state in which they were delivered (including original packaging and leaflets).
The customer is invited to lodge his complaint by e-mail to our customer service department at service.customer@designandasia.com.
No exchange, refund, or replacement can be taken into consideration unless the customer files a complaint beforehand.

Damaged or defective item
In the event that after taking delivery, the customer observes while unpacking that the product is damaged or defective, the customer can lodge a complaint by e-mail to our customer service department at service.client@designandasia.com . You will have to send us the picture corresponding to the damage. In the event that damages were incurred prior to the customer’s taking delivery, Design and Asia undertakes to replace the defective item. Design and Asia assume the cost of the second delivery. The return shipping cost will be paid for by the customer.

8-Personal information

Personal information collected on the www.designandasia.com website is necessary for managing orders and shipments, and for communicating with the customer. Any information collected is strictly confidential and is destined only to Design and Asia . An internaute has the right to access and rectify any data concerning him. 9-Cancellation
Design and Asia reserves the right to cancel any order for which we determined there is a fraudulent risk, real or assumed.
